This document outlines the terms and conditions governing the use of our Websites and Services by individuals or entities (hereinafter referred to as “Users”). Cherrytree Partners Limited, a company registered in England and Wales, with its principal place of business at 843 Finchley Road, London, NW11 8NA, United Kingdom (hereinafter referred to as “Astellar AI”), is pleased to grant Users access to the Astellar AI website (hereinafter referred to as the “Website”), and related applications and resources (collectively, the “Services”). The use of these Services by Users is contingent upon their agreement to comply with the binding legal agreement delineated below (hereinafter referred to as the “Terms”).
Beta Software
Astellar AI may, at its discretion, provide Users with access to beta and experimental products, features, and documentation (hereinafter referred to as “Beta Software”) on an early access basis. It is essential to note that Beta Software is not generally available and may contain errors, defects, and inaccuracies. Astellar AI provides Beta Software “as is,” without any warranties, and reserves the right to terminate access to Beta Software at any time without ensuring the preservation of Beta Software data. Service level agreements do not apply to Beta Software. In the event that Beta Software becomes generally available, Users may opt to pay for the software or discontinue its use. Astellar AI may utilize User feedback regarding Beta Software.
Use of Astellar AI Services
Users may employ the Astellar AI development platform to create software applications tailored to their target user groups to achieve their commercial objectives. Users should be aware that the language and information generated by software applications developed using the Astellar AI platform are derived from user-written prompts of our Large Language Models (LLM). It is crucial to understand that LLM technology is in an early stage of development, and any adverse consequences arising from the language and information generated cannot be attributed to Astellar AI, particularly if Users commercialize their applications but fail to meet their operational expectations (including, but not limited to, failing to meet advertising description expectations, target effect description expectations, etc.) or experience service interruptions.
The creation of prompts for LLM models constitutes a core product capability and service provided by Astellar AI. While using Astellar AI for prompt engineering, embedding, fine-tuning, and testing of LLM models, Users should be prepared for potential additional resource consumption. By registering or initiating the use of Astellar AI, Users consent to the potential resource consumption and associated costs related to the LLM algorithms utilized in this product. Users are responsible for closely monitoring billing changes from third-party LLM providers and shall bear the consequences of any abnormal consumption and billing issues that hinder their normal utilization of Astellar AI services.
Intellectual Property
All rights, title, and interest in and to the Services, including but not limited to the Services themselves, logos, interfaces, photos, and Websites, are owned by Astellar AI, or its licensees and are protected under applicable law. Astellar AI places great importance on safeguarding intellectual property rights, including copyrights. Astellar AI reserves the right to terminate Users’ access to, or use of, all or any part of the Services, without prior notice, in the event of Users’ infringement or misappropriation of the intellectual property rights, including copyrights, of others.
Applicable Law
These Terms are governed by the laws of England and Wales, and any disputes arising under or in connection with these Terms shall be subject to the exclusive jurisdiction of the courts located in London, UK.
